Tidal works applications

From 18 December 2009 applications for new tidal works are administered under the Sustainable Planning Act 2009 (PDF, 2.57MB) under a system called the Integrated Development Assessment System (IDAS). (Note: applications approved under the former Integrated Planning Act 1997 will continue to be managed in accordance with the legislative provisions that were in force when the development was approved.) 

Development applications include:

  • tidal works (including prescribed tidal works)
  • disposal of dredge spoil and other solid waste in tidal water
  • reclamation of land under tidal water
  • construction of canals associated with reconfiguring a lot.

Tidal works cover works for the construction of a basin, boat ramp, bridge, embankment, groyne, jetty, pipeline, small craft facility and the like. This work takes place on, under or above land under tidal water.

An assessment manager administers the IDAS process. The assessment manager for a development application is usually the local government authority. In some circumstances a state government department or other agency may be the assessment manager. Generally if development is wholly within the local government authority area and is assessable against a planning scheme, the relevant local government authority will be the assessment manager.

Concurrence agencies, which are usually state government departments or statutory authorities, have a responsibility to assess development applications within their jurisdiction.

Maritime Safety Queensland, as a concurrence agency under the Sustainable Planning Act 2009, assesses applications from a navigation and maritime management perspective.

Under the IDAS a concurrence agency has power to:

  • assess an application within the limits of its prescribed jurisdiction
  • request further information from applicants
  • impose conditions
  • refuse a development application
  • inform the assessment manager the approval must be for part only of the development, or that the approval must be a preliminary approval only.

Prior to lodging an application with an assessment manager, applicants may lodge details of the proposed works with Maritime Safety Queensland, or request a prelodgement meeting to determine requirements of an application.
